Virginia Skill Game Ban Could End As New Law Nears Approval

After years of uncertainty surrounding the legality of skill games in Virginia, they could soon return following a ban introduced under temporary pandemic-era legislation.

Stakeholders have pushed for new laws to establish a clear and regulated framework for skill games.

The legislation has now been approved by the Virginia General Assembly and is awaiting final sign-off from the governor.

If signed into law, it would introduce strict consumer protections, including a 25% tax on gross profits, a minimum player age of 21, and limits on the number of machines permitted at each location.

Push To Regulate And Eliminate Illegal Machines

Proponents of the new law argue it will help clean up the many illegal and unregulated gaming machines operating throughout Virginia’s black market.

The regulations will also give law enforcement a clearer way to differentiate between legal and illegal gambling businesses.

In addition, the return of skill games is expected to provide a much-needed source of income for small business owners.

Supporters note that many family-owned businesses and convenience stores lost significant revenue due to inconsistent enforcement of previous bans, and believe the new framework will offer greater stability.

“Virginia’s proposed skill game law reflects a broader push to regulate gray markets, offering economic relief for businesses while raising important questions about gambling access and long-term social impact.”

Concerns Over Gambling Expansion Persist

Several legislators oppose the proposed law, citing increased access to gambling and concerns about addiction.

Others warn of the potential for fostering a broader gambling culture in the state, particularly if skill games become widely accessible.

With the legislation now before the governor, supporters remain cautiously optimistic that years of litigation and delays surrounding the legalization of skill gaming may soon come to an end.

As a result of the absence of any clarity regarding these machines ever since they had originally been made illegal after COVID-19 ended, small business owners and supporters of the gaming industry have been trying to obtain clear legislation on whether these machines are now allowed to operate legally.

Therefore, a permanent, regulated market for skill gaming will resolve the ongoing confusion surrounding whether skill-based gaming can legally take place in Virginia.

Supporters of the legislation now turn their attention to the governor's office where a signature will bring an end to one of Virginia's most drawn-out legislative disputes regarding gambling.
