ASA Rules Against Affiliate Ad On Self-Exclusion Search

ASA Rules Against Affiliate Ad On Self-Exclusion Search

The Advertising Standards Authority (ASA) has upheld a complaint against a betting affiliate whose paid search ad appeared when a user searched for self-exclusion help.

The ruling, published on October 28, 2026, found the ad was not responsibly targeted and breached the CAP Code's social responsibility rule. It is a clear reminder for anyone running paid search for betting sites.

The ruling concerns Optival Ltd, trading as bestbookiesandbettingsites.co.uk.

The Ad And The Complaint

The ad was a paid search result seen on August 10 after a search for the phrase self exclusion bookies. It promoted Top 15 Betting Sites UK, invited users to compare bookmakers and offered an exclusive first bet bonus and welcome offers from the UK's top online sports betting brands. The complainant challenged whether it had been irresponsibly targeted.

Optival said it had never targeted the phrase. After the complaint it reviewed its search term reports across all campaigns and found no record of search terms containing self exclusion, supplying a screenshot as evidence. It said it maintains dedicated negative keyword lists designed to block searches relating to self-exclusion, GamStop and problem gambling.

The company argued the ad most likely resulted from the platform's automated query matching rather than keywords it chose, and that the fact it was missing from the reports suggested an isolated incident below the platform's reporting thresholds. It said it would expand its negative keyword exclusions across current and future campaigns.

What The ASA Decided

The ASA said a consumer searching for self exclusion bookies was likely to be seeking information, advice and support on how to limit their exposure to gambling services. Such searchers were likely to include vulnerable people trying to reduce their exposure to gambling ads, it said, and an ad offering the best welcome bonus offers was not appropriate for that search.

The regulator accepted that the site is an affiliate comparison website rather than a gambling operator, but said the ad still had the effect of promoting online betting sites and bookmakers. It noted the Code requires gambling ads to have particular regard to protecting vulnerable people from harm or exploitation, and said that, given the potential for considerable harm, marketers should have extremely robust controls to prevent inappropriate targeting.

The ASA welcomed Optival's commitment to broaden its exclusions but said robust measures should already have been in place. Because there was a strong likelihood vulnerable consumers seeking to self-exclude had been served an ad for betting sites, it concluded the ad had not been responsibly targeted and breached CAP Code (Edition 12) rule 1.3 on social responsibility.

What Happens Next?

The ruling directs that the ad must not be served again following the search self exclusion bookies, and the ASA told Optival to ensure its search ads are responsibly targeted.

The decision turns on outcomes rather than intent. Optival had negative keyword lists in place and said the match came from automated query expansion, yet the ASA still held the targeting controls were not sufficiently robust at the time the ad was seen.

For affiliates and operators alike, that points to regularly auditing search term reports and keeping exclusion lists for self-exclusion, GamStop and problem-gambling queries current, especially where platforms use broad or automated matching.
