Sports betting has been legal in Massachusetts since March 10, 2023. 

The state allows betting on most professional sports, while betting on college sports is partially limited in Massachusetts. Betting on youth sports and inter-collegiate competitions is not allowed.

Licensing is handled by the Massachusetts Gaming Commission (MGC), which has specific license categories for different operators.

Massachusetts sports betting law permits up to 15 online sportsbooks, and retail sportsbooks are allowed in casinos and racinos.

Governor Charlie Baker signed HB 5164 on August 10, 2022, declaring betting legal in Massachusetts. 

While Massachusetts House lawmakers broadly agreed that legalizing sports betting would be beneficial for the state, significant disagreements delayed passage of every bill. Lawmakers debated the tax rate applied to Massachusetts betting sites and whether betting on in-state college teams should be banned. 

In the end, the final terms of HB 5164, titled the Massachusetts Sports Wagering Act, were as follows:

  • Legal for individuals 21 years or older, but is restricted to those physically present in the state. 
  • Sportsbooks are available to commercial casinos, racetracks or racinos, OTBs, and online operators.
  • 15 available online sports betting licenses, seven of which are under a competitive tender process, and eight allocated to land-based casinos or racetracks. 
  • The $5.2 million license fee is payable every five years.
  • Online sports betting is subject to a 20% tax rate.
  • Retail sports betting is subject to a 15% tax rate.
  • Betting on in-state college teams is prohibited unless playing in a tournament of four or more teams.

Massachusetts Betting Tax Rate

You are required to pay taxes if you earn winnings from Massachusetts betting sites. 

You won't have to pay any tax on a Massachusetts betting promo. However, you may be liable for state and federal taxes on revenue derived from gambling. 

As per the local laws, the Massachusetts state tax on gambling is:

  • 15% on retail sports betting (in-person) revenue
  • 20% on revenue from online sports betting

You must declare all your winnings to the IRS and complete a W-2G form if you win over $600. Massachusetts sportsbooks can withhold up to 25% of your winnings for tax purposes. You must also declare your winnings on your state income tax return, payable at a flat rate of 6.25%.
