Maryland Releases First Mobile Sports Betting Revenue Report

Bettors placed more than $186 million in wagers over the first nine days of mobile sports betting in Maryland, according to data released by the Maryland Lottery and Gaming Control Agency (MLGCA). That is an impressive total, but two numbers stand out even more: $63.8 million and $4,262.
The $63.8 million is the amount of promotional credits Maryland online sportsbooks handed out over the nine days. That is a third of all sports betting handle. The latter, $4,262, is the amount of tax revenue the state received because of the promotional credit tax deductions the state allows. The state believes the level of promotional play will decrease as time goes on.
“We expect mobile sportsbook operators to continue to offer a lot of promotional wagers in the coming months as they venture into a new market and work to attract customers," said Maryland Lottery and Gaming Director John Martin. "There was tremendous pent-up demand, and a lot of people are utilizing promotional offers from multiple operators simultaneously. But as many of the operators have acknowledged, this level of promotional play is not sustainable and based on our regulations, it will be curtailed over time."

Maryland regulators have approved several other operators: BetParx, Betfred, Fanatics, Bally Bet, and WynnBet. When these operators launch is not entirely clear at this point.
Retail Sports betting Performance: Maryland retail sportsbooks were open the entire month, tallying $33 million in betting handle, $4.8 million in revenue, and $700,000 in tax revenue.
Maryland Sportsbook Update TIMELINE
Five more sportsbooks have been awarded licenses by the the Sports Wagering Application Review Commission but it's unclear when any of those will be ready for final phase approvals by the state Lottery & Gaming Control Agency. Overall, the SWARC received 21 applications for mobile sports wagering licenses. That means that nine more online operator applicants could still be considered. Six applications were received for Class B sports wagering facility licenses which means that following recent SWARC action approving one those, five more applicants for those licenses could be considered.

Maryland Lottery & Gaming Control Commission approved qualifications last week for WynnBet and Bally's for online sports betting licenses. That approval is passed on to the SWARC (its next meeting is Dec. 14) and assuming SWARC "awards" the licenses, the companies go back to Lottery & Gaming for controlled demonstrations. Mobile and in-person sports betting already are underway in the state.

Seven mobile sportsbooks are expected to be active for the initial launch date on Wednesday: Barstool, BetMGM, Caesars, Betrivers, DraftKings, Fanduel and Pointsbet. Three other sportsbooks have been awarded licenses but are not yet ready to launch - Betfred, BetParx and Fanatics.
10 mobile sports betting operators applications were approved by Maryland regulators SWARC during a hearing today (moved up from Nov 21). So now, industry sources anticipate a Maryland mobile sports betting go-live date of Wednesday, Nov. 23, 2022. The only remaining step for the 10 approved applicants (listed below, along with their associated sports betting brand) is a Maryland Lottery and Gambling Control Agency (MLGCA) review. The 10 approved licensees are: Arundel Amusements, Inc. (BetRivers), BetMGM Maryland Sports, LLC (BetMGM), Crown MD Online Gaming, LLC (DraftKings), CZR Maryland Mobile Opportunity, LLC (Caesars Sportsbook), PENN Maryland OSB, LLC (Barstool Sportsbook), PPE Maryland Mobile, LLC (FanDuel), Riverboat on the Potomac, LLC (PointsBet), Greenmount OTB, LLC (Parx), Long Shot’s, LLC (Betfred), and Maryland Stadium Sub, LLC (Fanatics). However, Parx, Betfred and Fanatics will not likely be ready to go in time for the November 23 tenative launch date.
The Maryland Sports Wagering Application Review Commission is set to approve mobile and sports wagering licenses on Nov 16 - according to our reporter Larry Henry. SWARC are closer to legalizing mobile sports betting with a scheduled competitive license-award meeting for mobile wagering applicants with possibility to award 60 mobile licenses. Though the meeting was originally planned for November 21, SWARC Chair Tom Brandt told us “we’ve been working with our consultants from Taft Stettinius Hollister and Spectrum Gaming Group to accelerate the pace and hold it earlier” The commission might vote to award a license, deny a license or hold the applicant for future consideration. This earlier meeting may mean that the launch could occur at the end of November or first days of December - ahead of the NFL playoffs and Super Bowl.
The process of legalizing sports betting in the state hasn't been the smoothest. With Gov. Hogan stating to Gambling.com that the delay is “the byproduct of an overly complex piece of legislation that was skewed to appease special interest groups and organizations.” However, the good news for Maryland bettors is they will be able to start their sports wagering the moment sites go live. This will likely happen in December 2022.
Maryland lawmakers help faciliate geolocation and ID verification services in the state of Maryland by awarding GeoComply a Tier One Contractor License for its upcoming operations. A part of Maryland law opening a sportsbook includes requirements for bettors to be 21 and over and physically located within Maryland state lines.

The application window closes and Maryland regulators tell the Sports Wagering Application Review Commission that 10 online sports betting licenses will move ahead following alternative licensing standards, these include big operators like DraftKings, Caesars, BetMGM, Fanduel and Barstool. Larry Hogan, the MD governor, has urged the regulators to speed up the regulation process, so the state successfully launches online sports betting for the NFL season, noting that neighboring jurisdictions already allow it. Sports Wagering Application Review Commission stated that the sports regulation progress is at 95%. The state would start taking online sportsbook applications over the summer.
Five of the six available retail sports betting casinos in Maryland were responsible for an increase of 21.5% in revenue numbers in March versus February ($31,025,892 vs $25,526,147). With this massive rise, the state taxes also saw a massive influx, increasing by 328.7%. Live! In February, the six land-based casinos in Maryland combined to generate $162,965,304 in total gaming revenue. This figure represents an increase of $36,757,280 (or 29.1%) compared to February 2021. Of course, however, this figure does represent a time in which the casinos were operating under restrictions related to COVID-19. It was a 6% increase from the $153.75 million in January.
RSI announced it has entered into a partnership with Penn National Gaming, giving RSI the ability to offer real-money online sports betting via its Betrivers platform, subject to license availability, state law and regulatory approvals. Following the end of the public comment period, Maryland regulators offer an update on the licensing process. SWARC, meanwhile, initiates background checks on the 17 sportsbook operators who are hoping to become the first sportsbooks to legally operate in the state.
The rules and regulations for legal sports wagering are unanimously approved by the Maryland Lottery and Gaming Control Commission. Marylanders are permitted 30 days to add their comments before hopeful operators can begin the application process.

Is Maryland Sports Betting Legal in November 2022?
Yes - sports betting in Maryland is legal since Governor Larry Hogan signed HB 940 into law to legalize both retail and mobile wagering in May 2021. That legislative measure established rules to ensure an inclusive array of mobile operators are offering betting apps in the state. Maryland’s Path to Legal Mobile Sports Betting
As noted, Maryland legalized sports betting through a ballot referendum in November 2020. The legislature passed enabling legislation in May 2021. Maryland retail sportsbooks were up and running by the end of 2021, but a complex regulatory structure bogged down mobile betting.
Maryland has two layers of oversight, the Maryland Lottery and Gaming Control Agency (MLGCA) and the Sports Wagering Application Review Commission (SWARC). The latter was created to deal with the licensing process and ensure the Maryland sports betting market included women and minority-owned businesses.
The bifurcated system slowed the process as each regulatory body waited for the other to complete a task before reviewing the conclusions and sending them back for approval with their own changes.
Maryland Sports Betting Law and requirements
In 2020, Maryland voters decided to amend the state legislature and make provisions for legalized sports betting. The ballot question was: “Do you favor the expansion of commercial gaming in the State of Maryland to authorize sports and event betting for the primary purpose of raising revenue for education?”
Hence, HB 940 passed by a motion of 122 in favor to 16 against in the House of Delegates. The Maryland sports betting bill was then signed into law by Governor Larry Hogan on May 18, 2021 but went into effect in July 2021. In December 2021, Maryland retail sports betting went live at BetMGM Sportsbook at the MGM National Harbor, followed by Caesars Sportsbook at the Horseshoe Casino and the FanDuel Sportsbook at the Live!
SWARC prioritized awarding 10 mobile licenses for retail entities named in the original mobile betting legislation which qualified through Maryland Lottery and Gaming and which choose to offer mobile wagering. To get legal MD sports betting apps up and running, the Maryland Lottery and Gambling Control Agency (MLGCA) reviewed the 10 approved sports betting licenses and approved further mobile sports wagering license applications on a rolling basis.
Details of the Bill
Bill HB 940 allows for the provision of legal, fully-regulated sports betting in the state of Maryland. Covering both in-person betting and online wagering, the bill ensures up to 40 retail licenses are up for grabs, with these broken down into Class A and Class B licenses. The former issued to casinos, horse tracks and professional sports teams in the state, with the latter being made available to retail stores offering sports betting and institutions like the Maryland State Fairgrounds.
In terms of online licenses, Bill HB 940 offers up to 60 — making it the largest licensing cap to feature in any U.S. state — and these are available to both retail operators and mobile-only sportsbooks. This is in contrast to other states which stipulate an online brand must be tied to a land-based casino in order to operate legally, but many hopeful applicants have nevertheless formed partnerships in Maryland.
Maryland lawmakers have approved two types of licenses as follows:
Class A licenses: 10licenses for Maryland’s six casinos, three professional sports teams/stadiums and the Maryland Jockey Club (including Laurel Park and Pimlico Race Course.) There is potential for licenses for NBA, NHL, and MLS teams in the future.
Class B licenses: 30licenses for businesses with physical locations in Maryland - up for bidding. Seven additional Class B licenses are for Maryland State Fairgrounds, four off-track betting parlors and two commercial bingo halls with 200 or more machines.
Those operators who hold both types of licenses could apply for one of the 60 mobile wagering licenses. The state will revisit these licensing types and assess whether more are needed in December 2025.
