Latest Georgia Online Sports Betting Update - February 2023

Georgia sports betting bill SB 57 recently stirred to life, as the Senate Economic Development Committee passed it by an 8-1 margin. SB 57 would legalize retail and mobile sports betting in Georgia without a constitutional amendment. Instead, SB 57 would put sports betting under the purview of the Georgia Lottery.

This would allow Georgia to legalize sports betting without bringing the matter before the voters. The bill still has a long way to go. Its next stop is the Senate Rules Committee. An affirmative vote there would put it in the queue for a vote on the Senate floor. Georgia online casinos are also still not available, but social casinos are.

 

Launch of Legalized Sports Betting in Georgia

When will online sports betting be available in Georgia? With Georgia sports bill SB 57 passing recently, there is hope for sports betting to be legalized soon but there is still a long way to go, as the bill still needs to pass a vote on the Senate floor. If this happens soon, the first Georgia bookmakers will probably go live in 2023.

Georgia’s first attempts to legalize sports betting came in 2020. With neighboring Tennessee passing a sports betting bill in 2019, however, delays caused by COVID-19 saw the bill not make any headway for a while but we're starting to see some real progress with SB 57 being passed. Although, it is unlikely that sports betting will be legalized in Georgia until late 2023/2024 as this bill still has a long way to go.

Timeline on Legal Sports Betting in Georgia

  • SB 57 was recently passed by the Senate Economic Development Committee. This bill would allow retail and mobile sports betting to be legalized without bringing the matter to the voters. However, the bill still needs to pass the Senate Rules Committee followed by a vote on the Senate floor.

  • A group of state senators is proposing a standalone sports betting bill run through the Georgia Lottery. SB 57 would create two categories of licenses: Type 1 – Mobile sports betting licenses. No less than nine and no more than 18 will be made available. Type 2 – Retail sports betting licenses. No less than five and no more than 10 will be made available. Georgia will set aside nine Type 1 licenses for in-state professional sports teams, the PGA, and select venues, like Augusta National (The Masters) and Atlanta Motor Speedway (NASCAR).

  • A standalone bill called SB 57 was proposed through the Georgia lottery. The bill at first faced some resistance from those who would prefer to legalize casino & sports betting via a constitutional amendment however this would not be possible until Nov. 2024. There were also concerns about whether this would undermine efforts to bring land-based casinos to the state.

  • Georgia lawmakers in favor of betting received support from the state’s largest sports franchises in 2021. Coming together as the Georgia Professional Sports Integrity Alliance, the Atlanta Braves, Atlanta Falcons, Atlanta Hawks, and Atlanta United, called for wagering to be regulated.

    This was great news for those in favor of GA sports betting. However, it wasn’t enough to move the needle. Rep. Stephens, along with Rep. Alan Powell, were championing sports betting bill SB 142 for much of 2021. This sports betting legislation passed through the Georgia Senate but not the House due, in part, to time restrictions.

    The good news, however, is that SB 142 did find some support among Georgia lawmakers. Moreover, it will be reintroduced in 2022. Assuming it makes it through the Senate and the House, voters will get to decide if it becomes law. How long this will take is unclear. The chances are that this Georgia sports betting bill might become law in 2022, which would mean legal sportsbooks probably won’t launch until 2023.

  • SB 403 was the first sports betting bill in Georgia. It was submitted to the Senate in February 2020 and took inspiration from what Tennessee’s lawmakers had passed. Although it didn’t progress past a committee vote, it proposed a 10% tax rate and $900,000 licensing fee for online sportsbooks.

    Rep. Ron Stephens also pushed to regulate sports betting in Georgia. His bill, HB 378, would have allowed the people of Georgia to vote on amending existing laws. Stephens contended that Georgia residents should have the right to approve amendments that would make general sports betting, horse racing betting, and casinos legal in Georgia. Unfortunately, others didn’t support his view.

Current Georgia Sports Gambling Laws and Bills

Georgia could soon be a gambling state. Georgia sports betting bill SB 57 was recently passed by the Senate Economic Development Committee. This bill would create two categories of licenses:

This would allow retail and mobile sports betting to be legalized without needing to be voted on by the public. However as it stand, sports betting is yet to be legalized and there aren’t any casinos. There were efforts to license two land-based casinos in 2017, but they didn’t even make it out of the gate. It’s a similar story with Daily Fantasy Sports and horse racing.

There are Fantasy Sports sites operating in the state, but it’s an unregulated (grey) market. Horse racing is also legal, but there are no tracks and pari-mutuel wagering is outlawed. Therefore, currently, the options for Georgia residents are limited.

How to Bet on Sports in Georgia

It’s not possible to bet on sports in Georgia at the moment. However, this could change soon with SB 57 recently being passed. Based on the fact that Georgia doesn’t have any land-based casinos, all bets will (probably) be made via desktop and the best sports betting apps on the market. 

Projected GA Sports Betting Revenue and Taxes

The state would tax sports betting at 20%. Operators can deduct the federal excise tax from their taxable revenue but cannot deduct promotional credits. Retail licenses cost $100,000 annually. Mobile licenses come with a far heftier $1 million annual fee.

Previous sports betting bills have sought to tax operators 10% of their profits and charge a $900,000 licensing fee. These may not be the rates Georgia lawmakers settle on, but they’re likely to be somewhere around these figures.In terms of revenue potential, GA sports betting operators can look to the Volunteer State for inspiration. The Tennessee monthly sports betting handle is over $300 million. That equates to a monthly revenue of more than $20 million.

Legal Sports Betting Options Currently Available in Georgia

Sports betting hasn’t been legalized in Georgia, but the hope is that laws will pass in 2022. If this happens, you’ll be able to bet on football, baseball, and more in 2023.

Georgia Retail Betting Locations and Partnerships
