Is Online Gambling Legal in Oklahoma?

Oklahoma Online Gambling Laws & History

Oklahoma instituted a sweeping gambling ban in 1916, a policy that would remain in place for nearly a century before the Sooner State began to loosen its gambling policies.

The state first began to recognize legal horse race betting in 1982. It was approved by a majority of counties in the state and led to the implementation of several racetracks, which were also permitted to have electronic gaming machines.

Oklahoma began to allow legal bingo games in 1987, and the changing tides eventually led to a gambling compact with Oklahoma tribes. This allowed for bingo and some electronic games, as well as pari-mutuel horse betting, on tribal lands.

The Charitable Games Act was passed in 1992 and allowed for pull tabs, bingo and other types of raffles. In 2004, the state finally approved Class 3 games and opened the door for different types of electronic games, slot machines and table games at tribal casinos. The Oklahoma State Lottery was approved and rolled out in 2005.

Timeline of Gambling Legislation in Oklahoma

After the introduction of legislation in 2003, and a referendum in 2004; the Oklahoma lottery begins. The Oklahoma lottery quickly grew to include interstate games such as Powerball.

After many years, state officials finally begin negotiations for a compact to upgrade Class 2 gaming to Class 3. This gets approved, directly leading to a boom in tribal casinos.

The Charitable Games Act is passed into law. This allows bingo, pull-tab games and other raffles to be hosted under license of the Alcoholic Beverage Law Enforcement Commission (ABLE).

First gaming compact signed with the Oklahoma tribes, enabling Class 2 games* (bingo or lottery-type games including electronic machines), as well as pari-mutuel horse racing on tribal lands. *Games operated by computers yet assisted by live dealers are often included in this definition.

Horse race gambling in the form of pari-mutuel betting is first legislated. This eventually comes into law in 1983, with 12 of Oklahoma’s 15 counties approving the vote. In time, off-site betting and gaming machines for the three major race tracks would also be approved.

Oklahoma Sports Betting

Oklahoma hasn’t had any luck advancing legal sports betting legislation. The U.S. Supreme Court gave individual states the power to legalize sports gambling with a 2018 decision to strike down the Professional and Amateur Sports Protection Act. Oklahoma, which has been slow to adopt gaming legislation in the past, so far hasn’t moved to include sports gambling as an option for Sooner State residents.

When Will Oklahoma Legalize Online Sports Betting?

Oklahoma will first need to legalize land-based sports betting before online sports betting, which may or may not come at the same time. Oklahoma Gov. Kevin Stitt in 2020 attempted to authorize sports betting at certain tribal casinos, but the state Supreme Court ruled 7-1 against Stitt and decided he did not have the power to implement the new gambling laws.

We’ll have to wait and see if the governor or any further legislation can have more success in bringing legal sports betting to Oklahoma.

Daily Fantasy Sports Betting in Oklahoma

Like many states, Oklahoma hasn’t made a legal ruling for or against Daily Fantasy Sports. That means Oklahoma DFS players are free to participate in the popular contests with operators like DraftKings and FanDuel. This practice will continue as acceptable under this gray area of the law unless lawmakers rule definitively for or against DFS contests in the future.

Horse Betting in Oklahoma

Horse race betting in Oklahoma was legalized in 1982. Several racetracks on tribal land across the state now offer live racing, pari-mutuel racing and casino gaming with electron games and classic table games.

What Sports Can I Bet On When Oklahoma Legalizes Sports Betting?

Some states with legal sports betting have prohibited betting on in-state college teams, while others are all-inclusive. Some allow for betting on eSports. Others do not.
