Is Online Gambling Legal in Mississippi?

While state law doesn’t specifically mention online casino gambling, the Mississippi Gaming Commission, which regulates gambling in the state, makes its position clear, stating on its website: “Internet gambling is illegal under state law.’’ The commission also warns about wagering with unlicensed and offshore casino outlets, saying “it is illegal to place bets from Mississippi with these businesses.’’ Therefore, brands offering promotions similar to NJ online casino bonuses won't be available until the state regulates online gambling.

Several of the state’s casinos offer their own branded online social casinos, which offer free casino gambling play with virtual coins for comps and prizes. Sports wagering at the state’s commercial casinos is available only through in-person betting at casino sportsbooks. State law allows mobile sports betting only if conducted on-site at the casino - not very practical, especially considering only the tribal casinos currently offer a Mississippi sports betting app.

Mississippi allows residents to wager on Daily Fantasy Sports. The state permits pari-mutuel wagering at licensed casinos, but has no racetracks and prohibits all online pari-mutuel betting.

When Will Mississippi Legalize Online Gambling?

Difficult to say, with later more likely than sooner. The state relies heavily on the tax revenue from its more than two-dozen casinos and there seems to be little legislative appetite to add online casino gambling to the mix.

Sports betting is a different story. Several bills that would authorize mobile online betting were introduced by state lawmakers in 2019 and 2020, though none advanced to a vote. With several states seeing up to 80% or more of its sports wagering handle placed online, some Mississippi lawmakers will continue to pursue mobile sports betting. If eventually approved, it could move the needle on online casino gaming.

The “Mississippi Miracle” is no exaggeration.

Like most other Southern states, Mississippi enacted strict gambling bans in the late 1800s that remained largely unchanged for the better part of the next century. Then Mississippi broke through the ban in a development that was at the time shocking for not just the region but the nation.

Mississippi was and still is dominated by conservative religious, cultural and political conditions which have historically been largely averse to any form of gambling. But seeking new ways to generate revenues in a struggling state economy, officials began steadily gaining support for legal gambling.

Starting with the success of New Jersey’s commercial casinos in the 1970s and federally recognized Native American tribes on tribal lands in the 1980s, Mississippi increasingly saw gambling as a means to attract tourists from across the nation. Lawmakers overcame gambling opponents to support modern riverboat casinos and eventually land-based facilities.

Decades later, it’s still shocking that Mississippi was just the third state in the nation with commercial casinos. Regional neighbors such as Georgia, South Carolina, North Carolina, Alabama and Tennessee still don’t have any commercial gaming facilities within their borders.

Mississippi’s casino market grew and contracted over the years, eventually settling into a dependable industry that contributes billions in economic impact each year. The 2019 approval for a state lottery, which had been delayed for years largely over fears it would cannibalize casino revenues, will only further Mississippi’s gaming revenues.

The next wave of gambling developments, namely online casino gaming and sports betting, will likely be tougher sells in the state. But even now, its proactive embrace of gambling has made Mississippi the top gaming state in the region and to this day one of the largest markets in the country.

Timeline of Gambling Legislation in Mississippi

Mississippi Sports Betting

When the U.S. Supreme Court struck down the law that prohibited single-game sports betting outside Nevada, Mississippi officials were ready. The state’s gaming commission immediately crafted regulations and less than three months later, on Aug. 1, 2018, the first legal sports wagers were accepted at the Beau Rivage and Gold Strike. Several other Mississippi casinos quickly set up sportsbooks and sports betting is now a staple at the state’s casinos.

The law, however, primarily allows only in-person retail sports betting at licensed casinos. Mobile sports betting is permissible only while on-site at those casinos. As a result, Mississippi annual sports betting revenue lags far behind states such as New Jersey, Pennsylvania, and even Indiana, which implemented sports betting a year later than Mississippi.

In 2018, the Mississippi Band of Choctaw Indians became the first in the U.S. to offer sports wagering at a tribal casino. The Choctaws, who now own and operate three casinos in Mississippi, went live with the state’s first mobile sports betting app in 2019, with online wagering only allowed on casino premises.

When is Mississippi Legalizing Online Sports Betting?

A date is difficult to pinpoint, but online sports wagering in Mississippi is likely to become a reality.

A 2019 bill that would authorize online sports wagering failed to make it out of committee. Legislators tried again in 2020 with the same result. It’s reasonable to believe an online sports betting bill will eventually become law because:

Daily Fantasy Sports Betting in Mississippi

A Daily Fantasy Sports bill was legalized in 2017, a year after state lawmakers approved it on a temporary basis.

All of the biggest national DFS operators are active in Mississippi, including Draftkings, FanDuel, Yahoo and Fantasy Draft.

Horse Betting in Mississippi

Mississippi has no licensed horse/greyhound tracks or off-track wagering facilities and pari-mutuel wagering is only permitted at licensed casinos. The Palace Casino Resort in Biloxi was the first casino to accept horse race wagering in 2019.

Most casinos in the state do not offer pari-mutuel wagering, and national online horse racing wagering platforms such as TVG and TwinSpires are not permitted to accept Mississippi accounts.

Expected Online Sportsbooks to Launch in Mississippi

It’s not a stretch to forecast that most if not all Mississippi casinos will offer an online/mobile sports betting alternative whenever it becomes legal. Several Mississippi sportsbooks are already owned or managed by experienced online operators, which would make for a quick transition.
