Is Online Gambling Legal in Wisconsin?

Nearly all forms of online betting are not legal in Wisconsin.

Legalizing online gambling is not at the top of the agenda of Wisconsin lawmakers. In fact, it’s not on their agenda at all.

The state’s constitution specifically prohibits most forms of gambling expansion. To change that would require a constitutional amendment, meaning passage of a bill in two consecutive legislative sessions, followed by voter approval in a statewide referendum. There would also be likely opposition from Native American tribes.

No bills were introduced the past two years that would allow for online casinos or online sports wagering in the state.

Wisconsin has no commercial casinos but is home to two dozen tribal casinos, each owned and operated by 11 federally recognized Native American tribes under the Indian Gaming Regulatory Act. Wisconsin Sports Betting

Sports betting efforts in Wisconsin have been conspicuously absent. While more than half of all U.S. states have legalized some form of sports gambling, Wisconsin has seen no movement in recent legislative sessions to introduce a sports betting bill.

Wisconsin has three major professional sports teams (Green Bay Packers, Milwaukee Bucks, Milwaukee Brewers) and would be an attractive market for sports betting operators. Instead, a Wisconsin player must cross state lines to Illinois, Iowa or Michigan to wager on sports, which they can do via mobile sports betting or visiting a sportsbook.

When is Wisconsin Legalizing Online Sports Betting?

By all indications, not soon. The state specifically prohibits most forms of gambling, including sports wagering, meaning a amendment to the constitution would need to be adopted. That’s a long process that would require passage of a sports betting bill in two consecutive legislative sessions, followed by voter approval in a statewide referendum.

One other possibility is for the state’s tribal casinos to consider entering the sports betting market. That would require the state’s 11 tribal nations to renegotiate their gaming compacts with the state and perhaps pay a significant fee to the state in exchange for exclusive rights to offer sports betting.

Daily Fantasy Sports Betting in Wisconsin

Daily Fantasy Sports operates in a gray area in Wisconsin. Since no state law specifically addresses it, nearly all DFS operators, including DraftKings and FanDuel, accept Wisconsin accounts. Legislation was introduced in 2016 and 2017 to legalize and regulate Daily Fantasy Sports in the state but failed to advance both times.

Horse Betting in Wisconsin

Voters approved pari-mutuel wagering in 1987 in a constitutional amendment. No horse racing tracks were built, but four greyhound tracks opened in 1990 and a fifth in 1991. All eventually closed for live racing (Dairyland Greyhound Park in Kenosha was the last in 2009), citing competition from casino gambling at tribal casinos.

A few of the state’s tribal casinos offer a pari-mutuel racebook for horse racing betting. Online advance deposit wagering pari-mutuel wagering is available on some platforms (TwinSpires, Xpressbet, NYRA Bets), but not all.

Expected Online Sportsbooks to Launch

Barring a change in state law, there are no immediate plans for online commercial sportsbooks in Wisconsin. It’s possible the state’s tribal casinos could decide to pursue some form of sports betting, but there has been little movement in that direction so far.
