Gov. Phil Scott made sports betting legal in Vermont when he signed HB 127 into law in June 2023. The Vermont sports betting market launched on January 11, 2024. Two to six online sports betting licenses are available.

Vermont Sports Betting Laws & Legislation

Vermont became the final New England state to legalize sports betting when Gov. Scott signed HB 127 on June 14, 2023. HB 127 legalized online sportsbooks but prohibits sports betting in retail locations. 

Sports betting was legalized in June 2023, and the sports betting market launched on January 11, 2024. Retail sportsbooks have not been legalized, so betting apps are the only way to bet on sports in Vermont. It was determined that the state lacked the necessary infrastructure to support in-person betting. 

Vermont sports betting sites are required to pay a 20% tax on revenue, as well as a $550,000 fee payable every three years.

Currently, DraftKings, FanDuel, and Fanatics Sportsbook operate in the state. While some major operators, such as BetMGM, applied, they were not approved during the initial launch, leaving room for potential future expansion.

Comparing Vermont Sports Betting vs. Other Legal States

  • Taxes: Sports bettors face the same tax situation in all U.S. states. All winnings from sports betting are taxable, and you must complete a W-2G form if you win over $600. All sports betting winnings must be declared to the IRS. Specifically, in Vermont, you must also include your gambling winnings in your state income tax, payable at a rate of 6% if you are a resident of the state and 7.25% if you're from another jurisdiction.
  • College Sports Restrictions: Sports betting in Vermont has similar betting restrictions to those in other New England states when it comes to wagering on college teams. All states in New England prohibit betting on in-state college teams during the regular season. Massachusetts and Vermont have chosen to lift this restriction if in-state college teams play in a postseason tournament of four or more teams.
  • Other Restricted Markets: Betting on high school sports is illegal in all 50 US states, and betting on in-state college teams is prohibited in all New England states. Betting on events such as the Academy Awards is restricted in all states in New England except for Massachusetts.
  • Age Requirements: You must be 21 years or older to wager with an online sportsbook in New England. As with all other legal betting states, you must be physically located in the state to place an online bet. Your Vermont sportsbook will use geolocation technology to track your location and only permit you to bet in areas where it is legal.

Vermont bettors had to wait a long time for the day when the state legalized sports betting. Vermont lawmakers reviewed proposed bills in 2019 and 2021, but HB 494 and SB 77 failed to gain momentum. Subtle changes were made in 2023, and the proposed Vermont sports betting laws were approved.

  • Jan. 11, 2024: Sports betting launches in Vermont. DraftKings, Fanatics Sportsbook, and FanDuel are the first three operators to go live.
  • Dec. 12, 2023: The Department of Liquor and Lottery announces FanDuel, DraftKings, and Fanatics' licenses are approved, and that pre-registration can open for these three operators.
  • Dec. 11, 2023: Governor Scott and DLL Commissioner Wendy Knight announce that regulated sports betting will officially launch on Jan. 11, 2024.
  • Sept. 14, 2023: The DLL issues a request for mobile sports betting operator applications, and five sportsbooks apply, including BetMGM and then-ESPN BET.
  • June 14, 2023: Gov. Phil Scott signs HB 127, legalizing betting in the state. It is expected that sports betting will be available in January 2024.
  • May 4, 2023: HB 127 passes a vote in the Senate and is referred to the House for concurrance.
  • March 24, 2023: HB 127 becomes the first sports bill to clear a vote from Vermont lawmakers, comfortably passing a House vote.
  • Feb. 10, 2023: House Bill 127, a sports betting proposal allowing for between two and six sportsbooks, is read for the first time and referred to the Committee on Government Operations and Military Affairs.
  • Feb. 11, 2021: Senate Bill 77 is introduced by Sen. Dick Spears, allowing for up to six sportsbooks. The bill fails to gain momentum and again dies on the floor.
  • June 17, 2020: Senate Bill 59 is messaged to the House from the Senate floor, but it never progresses past the General, Housing, and Military Affairs.
  • Jan. 7, 2020: Senate Bill 213, which would have authorized a framework for online sports betting, is read for the first time and referred to the Committee on Economic Development, Housing and General Affairs, where it stays. 
  • Feb. 28, 2019: House Bill 484 is presented to the House by Rep. Thomas Burditt. It is read in the House and referred to the Committee on General, Housing, and Military Affairs, where it remains.
  • Jan. 29, 2019: Senate Bill 59, which would create a Sports Betting Study Committee, is read for the first time and referred to the Committee on Economic Development, Housing and General Affairs, where it remains for the remainder of the 2019 legislative session.
  • May 14, 2018: The Professional and Amateur Sports Protection Act of 1992 (PASPA) is overturned by the U.S. Supreme Court. This landmark ruling enables individual states to determine the legality of sports betting.

Where Can I Bet on Sports in Vermont?

HB 127 does not permit retail sportsbooks, and as a result, there are no physical locations in Vermont where bets can be placed. All sports betting in Vermont will be done online via an app or mobile site. 

Vermont lawmakers made this decision due to concerns that the state lacked the necessary infrastructure to support retail sports betting, as it has no commercial or tribal casinos.
