Maryland Sports Betting Laws & Legislation

Maryland legalized sports betting in May 2021. Governor Larry Hogan signed House Bill 940, paving the way for both retail and online sports wagering. The law listed 17 entities already eligible to receive sports betting licenses, including casinos, racetracks, sports stadiums, and other locations. All online sportsbooks must partner with one of these state-qualified entities or an approved small business.

While retail sportsbooks were operational by December 2021, mobile betting faced delays due to a complex regulatory structure. 

The state has two central regulatory bodies: the Maryland Lottery and Gaming Control Agency (MLGCA) and the Sports Wagering Application Review Commission (SWARC). SWARC, in particular, was established to ensure inclusivity in the sports betting market, especially for women and minority-owned businesses.

Maryland's betting ecosystem serves a broader purpose. Casino proceeds are channeled to support vital community pillars, including the Education Trust Fund, local communities, the state's horse racing industry, and initiatives for minority-owned businesses.

Maryland House Bill 940: Licensing

This landmark bill was comprehensive in its approach, encompassing both in-person and digital sports betting. It proposed a distribution of up to 40 retail licenses. These were further bifurcated into:

  • Class A Licenses: Tailored for the state's elite establishments, including six casinos, three major sports teams/stadiums, and the renowned Maryland Jockey Club. There's also potential for expansion, with considerations for NBA, NHL, and MLS teams in the pipeline.
  • Class B Licenses: Crafted for businesses with a physical presence in Maryland, this category caters to diverse venues, from the Maryland State Fairgrounds to off-track betting parlors and sizable commercial bingo halls.

In a move that sets Maryland apart, HB 940 also greenlights up to 60 online licenses, the highest allocation across U.S. states. This provision is inclusive, welcoming both retail operators and exclusive online Maryland sportsbooks.
